correction: the travis county hemp trial never happened
our july update said the texas dshs consumable-hemp case went to trial on july 27. the trial was vacated — the state's interlocutory appeal is still pending before the fifteenth court of appeals, so there is no verdict and no timeline for one. the injunction was lifted june 5, which means dshs's march 31 rules remain enforceable while the appeal plays out. separately, the fda's section 781 cannabinoid lists — due in february — remain unpublished as of august 13.

texas delta-8 ban is in effect; federal judge declines to block it
texas's reinstated schedule I listing for delta-8, delta-10, thcp and similar isomers became enforceable july 31. a manufacturer, an austin retailer, and a consumer sued in federal court in galveston the same day, arguing the ban conflicts with the 2018 farm bill. on august 9 u.s. district judge jeffrey brown denied their emergency restraining order; a preliminary-injunction motion is pending. shops dumped inventory and cut hours ahead of the deadline, and early closures are being reported around the state.

senate votes 90-6 to delay most of the federal hemp ban by 30 days
the senate's continuing resolution, h.r. 6500, would push most of section 781's restrictions from november 12 to december 11, 2026. converted and synthetic cannabinoids — including nearly all commercial delta-8 — are carved out and still become controlled substances on november 12. the house passed its own funding bill without the delay and is not expected to act until september, so this is not law. plan around november 12 and treat december 11 as upside.

texas: delta-8 becomes an enforceable controlled substance july 31
texas reinstated its 2021 controlled-substance definitions covering delta-8 and other non-delta-9 thc isomers, enforceable with civil penalties starting july 31, 2026. this is a separate track from the dshs consumable-hemp rules, which remain tied up in the state's interlocutory appeal — the july 27 trial was vacated. texas shops carrying intoxicating hemp face state exposure three months ahead of the federal deadline.

fda still has not published its section 781 cannabinoid lists
the statute gave the fda 90 days — roughly february 10, 2026 — to publish the lists that define which cannabinoids fall inside the new federal hemp definition. congressional researchers confirmed in may that the guidance had not appeared, and no timeline has been offered since. the november 12, 2026 effective date is unchanged: plan around it and treat any delay as upside.

tennessee's thca ban takes full effect
tennessee's ban on thca sales became fully effective july 1, 2026, moving hemp oversight to the alcoholic beverage commission. shops in memphis and nashville have already pivoted or are pivoting inventory toward glass, kratom, and non-intoxicating cbd — a preview of what the federal deadline does everywhere on november 12.
